Terms of Service

1. Acceptance of Terms

By accessing or using the Krugertech (Pty) Ltd Dashboard ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Krugertech (Pty) Ltd ("we", "us", or "our") provides an online platform that facilitates the delivery of legal documents, such as letters of demand and summonses, through third-party sheriffs. We act as an intermediary to locate the appropriate sheriff, obtain quotes, and coordinate the delivery process on your behalf.

3. User Responsibilities

• Accurate Information: You agree to provide accurate, current, and complete information during the registration process and while using the Service.
• Legal Compliance: You are responsible for ensuring that the documents you submit comply with all applicable laws and regulations.
• Document Ownership: You confirm that you own or have the necessary rights and permissions to upload and distribute the documents you submit.
• Address Accuracy: You are responsible for providing the correct and complete address for service. We and the sheriff rely solely on the information you provide.

4. Fees and Payment

• Quotation: Upon your request, we will locate the appropriate sheriff and provide you with a quotation that includes the sheriff's fee and our administrative fee.
• Payment: You must make the payment through our designated payment processor, PayFast, before we proceed with your request.
• Non-Refundable: All payments are non-refundable once the service process has commenced, regardless of the outcome of the service attempt.

5. Service Limitations and Disclaimers

• No Guarantee of Service: We do not guarantee that the document will be served on the intended recipient or that effective service will occur. The service of documents depends on various factors beyond our control, including the accuracy of the address provided and the availability of the recipient.
• Address Limitations: The sheriff will attempt service at the address you provide. If the recipient is not found at that address, or if the address is incorrect, incomplete, or inaccessible, the sheriff may return the instruction with a Return of Non-Service after reasonable attempts.
• Unsuccessful Service: In cases where the recipient is unavailable, has moved, or the premises are closed, we are not responsible for unsuccessful service attempts.

6. Data Storage and Privacy

• Data Usage: Your personal information and documents will be stored securely on Firebase and Firestore.
• Purpose Limitation: Your information will only be used to fulfill your request and will not be shared with third parties except as necessary to provide the Service.
• Data Security: We employ reasonable security measures to protect your data but cannot guarantee absolute security.

7. Protection of Personal Information Act (POPIA) Compliance

• Lawful Processing: We process personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA").
• Consent: By using our Service, you consent to the collection, processing, and storage of your personal information as outlined in these Terms.
• Data Subject Rights: You have the right to access, correct, or delete your personal information held by us. To exercise these rights, please contact us at the details provided below.
• Third-Party Disclosure: We will only disclose your personal information to third parties, such as sheriffs, as necessary to fulfill your request and in compliance with POPIA.

8. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of Krugertech (Pty) Ltd or its content suppliers and is protected by intellectual property laws.

9. Limitation of Liability

• No Warranties: The Service is provided "as is" without warranties of any kind, either express or implied.
• Indemnification: You agree to indemnify and hold harmless Krugertech (Pty) Ltd from any claims arising out of your use of the Service.
• Liability Cap: Our total liability to you shall not exceed the total fees paid by you for the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

11. Modifications to Terms

We may update these Terms from time to time. Any changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict of law principles.
