KrugerTech (Pty) Ltd (“KrugerTech”, “we”,
“us”, “our”) operates the website
mysmallclaim.co.za
(the “Site”) and the associated drafting tools
(collectively, the “Service”).
This Privacy Policy explains how we collect, use, disclose and safeguard
your information when you use the Service. By accessing the Service you
consent to the practices described below.
1. Information We Collect
1.1 Account & Contact Details
Names, e-mail addresses, authentication credentials and any profile information you provide when you sign up or contact support.
1.2 Claim & Drafting Data
All information you enter while creating documents - e.g. plaintiff and defendant details, claim amount, selected language, narrative text and attachments.
1.3 Generated Documents
The final Letter of Demand, Summons, Defence and/or Counter-claim you generate, stored for quality control, user support and legal compliance.
1.4 Usage Analytics
Interaction metrics such as current drafting step, defendant type, claim type, payment status, delivery method (download vs email), AI-suggestion acceptance count, information-request count and document-generation time-in-seconds.
1.5 AI-Interaction Logs
The text you supply to the AI, the AI's questions, suggestions, and your acceptance or rejection of each suggestion, plus the final approved content.
1.6 Technical Data & Cookies
Device type, browser, operating system, IP address and cookies/session identifiers required for login, analytics, fraud-prevention and performance. You can disable cookies in your browser, but some features may not function.
2. How We Use Your Information
- Service Provision - to render, save, deliver and e-mail your documents.
- Improvement & Testing - to debug errors, benchmark AI quality, refine templates and develop new features.
- Analytics & Business Intelligence - to compile aggregated, anonymised statistics (e.g. average claim amounts, common languages) that no longer identify you.
- Security & Fraud Prevention - to protect the Service and comply with law.
- Support & Communication - to answer queries, send critical notices and keep you informed about your use of the Service.
3. Legal Bases (POPIA / GDPR)
We process personal information on the following grounds: (a) performance of a contract (providing the Service); (b) legitimate interests (service improvement, security); (c) compliance with legal obligations; and (d) consent (where you have expressly granted it - you may withdraw consent at any time).
4. Sharing and Disclosure
- Service Providers - e.g. Firebase, Netlify, e-mail and payment processors - bound by confidentiality and data-processing agreements.
- Legal Compliance - where required by law, court order or regulator.
- Protection of Rights - to investigate or prevent fraud, abuse or threats to safety.
- Aggregated Insights - non-identifiable statistics may be published or shared for research/marketing.
We never sell or rent your personal data.
5. International Data Transfers
The Service is hosted on cloud infrastructure that may be located outside South Africa. When data is transferred internationally we rely on contractual safeguards (standard contractual clauses or equivalent) to ensure it is protected to a standard comparable with POPIA and GDPR.
6. Data Retention & Deletion
Personal data is retained only as long as needed for the purposes in section 2 or to meet legal/accounting obligations, after which it is securely deleted or anonymised. You may request deletion by e-mail (see Section 10); statutory retention periods may override such a request.
7. Data Security
We apply industry-standard administrative, technical and physical safeguards. No method of transmission or storage is 100 % secure; we therefore cannot guarantee absolute security.
8. Your Rights
You have the right to:
- request access to the personal information we hold about you;
- request correction, deletion or restriction of processing;
- object to processing based on legitimate interests;
- withdraw consent at any time (without affecting prior lawful processing);
- lodge a complaint with the Information Regulator (South Africa) or another supervisory authority.
9. Children
The Service is not directed at children under 18. We do not knowingly collect personal information from minors. If you believe a child has provided us with personal information, please contact us and we will delete it.
10. Changes to This Policy
We may update this Policy periodically. Material changes will be announced on the Site. Continued use after posting means you accept the revised Policy.
